WHEN YOUR NATIONAL VISA TO POLAND MAY BE REFUSED
The (4) clients from Malaysia had previously applied to their national visa, ( work visa) in reference to the working permit provided already by the agents. However, the Polish Immigration Authority (embassy) had refused their applications on certain grounds, as per generic refusal letter: (9) (10) and (11). They came from different agencies/agents based in Taiwan and Malaysia. AFTER, our helped to them, (2) cases we reapplied and (2) cases we filed for an appeal. As a results, we got them ALL APPROVED!

Please note before the embassy grant your NATIONAL VISA application, they have certain guidelines and ACTS – Section IV, Chapter 1 of the issuing of Visas to follow by them to consider your application be granted on the basis of the visa you are applying – whether it is your first – time application and or you had any previous refusal from the other Schengen Member States.
But how can you avoid your national visa be refused? If we look into the act of Journal of Laws, here are the most “common legal basis to declined your visa application for Poland.
“Article 65. 1“. A foreigner shall be refused a national visa if at least one of the following premises occurs:
(1) his/her data is entered in the register of foreigners whose stay in the territory of the Republic of Poland is undesirable, or
(2) his/her data is entered in the Schengen Information System for the purposes of refusing entry, or
(3) he/she does not have sufficient financial means to cover the expenses to be incurred during the intended stay in the territory of the Republic of Poland and the costs of return to the country of origin or residence, or the costs of transit to a third country that will grant him/her a permit for entry, or he/she is unable to obtain such means lawfully, or
(4) he/she does not have the health or medical insurance referred to in Article 25(1)(2)(a), or the medical insurance referred to in Article 25(2), or
(5) it is justified by national security or defence, the protection of public safety and order or the interest of the Republic of Poland, or
(6) the foreigner’s travel document does not meet the criteria set out in Article 77(5), except cases where the criterion referred to in Article 77(5)(1) has not been taken into account due to the foreigner’s legitimate interest, or
(7) in the proceedings on issuing of a national visa:(a) the foreigner filed an application containing false personal data or false information, or attached to the application documents containing such data or information, or (b) testified untruthfully or concealed the truth, or forged or modified the document in order to use it as an authentic one, or used such a document as an authentic one, or
(8) has not justified the purpose and conditions of the intended stay, or
(9) there are justified doubts as to his/her intention to leave the territory of the Republic of Poland before the expiration of the visa.
(10) If the foreigner’s data is entered in the Schengen Information System for the purposes of refusing entry, a national visa may be issued only if there are material reasons for it to be issued, in particular for humanitarian reasons or because of international obligations, taking into account the interest of the state that has made the entry in the Schengen Information System.”
