Poland Successful Appeal for National Visa Approval

Our [x] client had been previously refused on the basis of #10 ground ““There are reasonable doubts regarding the reliability of the statement you made about the purpose of stay in the territory of the Republic of Poland due to the evidence that is available to the authority or due to the objective circumstances indicating that the purpose of stay could be different than declared”. He was a former OFW in Saudi Arabia before he got an offer to work in Poland (Please note we do not arrange for his employer or job for him). He left his job in K.S.A to pursue on his offer to Poland.
He made his application by himself during his first National Visa submission. Unfortunately, the decision was not favorable to him and therefore, he is planning to file for an appeal – but he was not sure, as to how he could possibly prepare some arguments and additional information or documents in relation to the above ground being identified to his refused National Visa.
Until accordingly, our services were referred by someone to him, as we have been assisting appeal and reapplication for Poland since 2019. We assessed his previous refused national visa and we believed that, on his part he “missed” a very important requirement when applying for a visa to work in Poland. In view thereof, the visa officer previously assessed his national visa application, had made “unfounded” decision and poor self -discretion in coming – up with the most acceptable reasoning which could have been more rational as per the Polish Immigration Act for Foreigner, in particular for a National Visa to work in Poland. Though, I cannot blame him/her given that our [x] client had NOT supplied any letter of explanation or cover letter, as to why he is applying for a visa to work in Poland, a part from the lacking “credible” documentation of his work.
In addition to this, with his submitted application previously refused; he had NOT been part/listed on Article 65 1. A foreigner shall be refused a national visa if at least one of the following premises occurs; sub. Par (s) (1) to (7), EXCEPT the sub. Par(s) (8) and (9), simply because he only relied to employer’s request letter for the visa – but not able to justify his purpose as to why he is applying for a National Visa. We then refer to the (2013) Journal of Laws of the Republic of Poland, Article 25 of the Act; “1. A foreigner entering the territory of the Republic of Poland shall be obliged to” Justify the purpose and conditions of the planned stay”.
We made his appeal letter to “justify” as to why he is applying for a National Visa to work in Poland and further, based on his circumstances, previous travel and additional supporting documents and information which we have had requested on him in relation to his appeal be granted to reverse previous decision. A week after of our submission to his appeal we got the approval of his National Visa.
