Ireland Appeal Approval for a Family Reunification under EU- Directive
Our [x] client from Ireland (Croatian National) had contacted us to assist on his wife’s visa to join him in Ireland. As we may know, there are information available for the process and list of documents needed when applying under this category. However, it may appear to understand that, applying for this type of family member (wife) reunification is easy, therefore for some they would try to “do it yourself” application and we believe and respect their rights to do so, however in most cases based on our 12- years of experience in assisting some visa types under this category; usually they tend to receive a “refusal” because of the lacking information and evidentiary documents and or, if there is a presumption that the marriage was done NOT in good faith.
However, after his submission on his wife’s visa to Ireland embassy, the visa had been refused – and that the case/visa officer was not satisfy that, he indeed exercising his EU rights. It is because he failed to submit the documents required to prove as such EU-rights. In addition to this, the officer concluded that their relationship is NOT genuine and that their main intention to getting married is for his wife to get an entry visa to Ireland.
Considering they got married for nearly 2-years now, and that [x] client have visited his wife country for several times. Yet, still the case/visa officer is not convinced in their “relationship” as it is genuine and subsisting, a part from the issue of certain document being pointed out to her refusal letter ( in a which marriage certificate is in poor quality), normally, after receiving the refusal letter one may only have 8-weeks to file for an appeal.
We helped this [x] client for his wife’s appeal preparation and application and that we thoroughly checked to wife’s document (s) so as his, to make sure every detail and significant information and documents were ALL included, when appeal had submitted. As one of the allegations is that their relationship is in a short period of time, prior to getting to marriage and applying for a visa in Ireland to join him. We supplied 7-pages of submission letter to argue his case to request for the revision previous decision, under the EU-directive of the “Free Movement Rights”. And today, we finally got its Approval!
